        We will never know how many lives 3M’s actions cost.  Being in a war zone is dangerous.  Being in a war zone without being able to hear is more dangerous.  Placing servicemembers in a war zone with defective gear because of greed is unforgivable.

       The 3M Company produced “Combat Arms Ear Plugs” for the U.S. military.  These earplugs were used by countless servicemembers, including many that were in combat starting in 2003 and ending in 2015.

       Between 2003 and 2015, these dual-ended 3M Combat Arms Ear Plugs, specifically version #2 were standard issued equipment for soldiers. These defective earplugs were given to military members both overseas in active combat as well as in training in the United States.  

       3M claimed that their defective earplugs could provide two different types of ear protection.  One type of ear protection was intended to block the maximum amount of noise and the other was intended to allow soldiers to communicate while protecting their eardrums from loud concussive explosive type sounds.

       3M did not allow a 3rd party to do the testing for their earplugs.  Instead, they did it themselves and when they discovered that the earplugs did not function properly, they stopped the testing and changed the testing so it had nothing to do with the way that the earplugs would actually be used. Eventually, 3M was able to work the tests so their earplugs passed.  3M sold their defective earplugs to the military.

         3M’s actions have given soldiers a lifetime of tinnitus (ringing or buzzing of the ears) and partial to full hearing loss. Foster & Foster wants 3M to pay for what they have done.  Even if a soldier chooses another law firm, we hope they will not let their deadlines pass.
